These Terms of Service ("Terms") govern your access to and use of Tracewall (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.
1. What Tracewall is — and isn't
Tracewall is a monitoring and evidence platform. We scan public marketplace listings, flag offers that appear to be below your Minimum Advertised Price (MAP) or from sellers not on your authorized-seller list, and provide timestamped records you can act on. Tracewall is radar and evidence — not an enforcement or takedown service. We do not remove listings, contact sellers on your behalf, or guarantee any enforcement outcome. Revenue-at-risk figures are transparent estimates of protected margin, not guaranteed recoverable amounts.
2. Accounts
You are responsible for the information you provide, for maintaining the security of your credentials, and for all activity under your account. You must provide accurate MAP and authorized-seller data; the accuracy of detection depends on it.
3. Subscriptions, billing and trials
Paid plans are billed through Paddle, our merchant of record, which handles payment processing and applicable taxes. Plans may include a free trial; unless canceled, trials convert to paid subscriptions. Fees are billed in advance on a monthly or annual basis and are non-refundable except where required by law. You can cancel at any time; access continues through the end of the paid period.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. In short: use the evidence factually, do not use the Service for unlawful purposes, and do not resell or redistribute the data.
5. Data and privacy
Our handling of your data is described in our Privacy Policy. Evidence records are retained as described there so they remain useful for your enforcement needs; you may export your data at any time.
6. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not warrant that detection is error-free, that every violation will be found, or that any figure or classification is legally conclusive. You (and your counsel) are responsible for decisions and actions taken based on the Service.
7. Limitation of liability
To the maximum extent permitted by law, Tracewall will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or revenues. Our total liability for any claim will not exceed the amounts you paid to us in the twelve months before the claim.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination, we will make your data available for export for a reasonable period before deletion, subject to the retention terms in our Privacy Policy.
9. Changes
We may update these Terms. We will post the updated version with a new "last updated" date and, for material changes, provide reasonable notice.
